Regulation (EC) No 648/2004 of the European Parliament and of the Council of 31 March 2004 on detergents
This Regulation establishes rules designed to achieve the free movement of detergents and surfactants for detergents in the internal market while, at the same time, ensuring a high degree of protection of the environment and human health. (Art. 1) 'Detergent' means any substance or mixture soaps and/or other surfactants intended for washing and cleaning processes. (Art. 2 (1)) Definitions of a 'substance' and 'mixture' are harmonised with REACH regulation.
Granting of derogation (Art.5) The request by a manufacturer for derogation shall be made by sending an application to the competent authority of the Member State concerned and to the Commission, providing evidence relating to the criteria mentioned under Art. 6(1). No procedure is established at the European Union level for submission of application for derrogation. The competent authority of the Member State will review the application and, in case that it is rejected, it will inform the manufacturer and the Commission. If the application for derogation is approved, the Commission will inform the relevant Committee and launch the comitology procedure. It is important to note that the derogation applies in all Member States.

The provisions of these articles are without prejudice to the provisions relating to the classification, packaging and labelling of dangerous substances and preparations in Directive 67/548/EEC and 1999/45/EC.
