Justification:

Persistence:

Based on the data of a BOD5 and COD determination the test substance FAT 40075 can be concluded to be not-biodegradable and stable in the environment.

In conclusion, it can be excluded that the substance should be regarded as only persistent (P) in the environment and not very persistent (vP) in the environment.

Bioaccumulation:

According to the screening criteria for bioaccumulation (B for bioaccumulative, vB for very bioaccumulative) given in the technical guidance provided by ECHA (ECHA 2008, Guidance on information requirements and chemical safety assessment, Chapter R.11), a substance does not fulfil the B and the vB criterion if its log Kow ≤4.5.

The octanol-water partition coefficient for the test item is log Kow = -3.46. This value is much below the threshold value of log Kow ≤4.5.

Toxicity:

The L(E)C50 values are greater than 100 mg/L when tested at all three trophic levels of aquatic ecosystem and the substance is not classified as CMR, hence it is not considered to fulfil the T criterion.

Hence, taking above arguments into account, it is concluded that Reactive Orange 035 is neither PBT nor vPvB.
