Experimental studies on the toxicity of Fatty acids, tall oil, esters with dipentaerythritol (CAS 70913-98-3) to activated sludge microorganisms are not available. In accordance to Regulation (EC) No 1907/2006 Annex XI, 1.5 a read-across to a structurally related substance Fatty acids, C16-18 and C18-unsatd., hexaesters with dipentaerythritol (CAS 68604-38-6) was conducted to fulfill the data requirements according to Annex IX of Fatty acids, tall oil, esters with dipentaerythritol (CAS 70913-98-3) in regard to toxicity to aquatic microorganisms. The fatty acid chain lengths of C16, C18 and C18 unsatd. of the read-across substance are identical to those of the target substance and both substances contain the same alcohol (dipentaerythritol) and are hexa-esters.

The assessment of the toxicity to microorganisms can be based on the NOEC determined in the toxicity control reported in the study on ready biodegradability with the read-across substance. This approach is suitable for substances with high degrading rates or no degradation inhibition in the positive control in ready biodegradability tests, in accordance with the Guidance on information requirements and chemical safety assessment (Chapter R.7b: Endpoint specific guidance, ECHA 2012). A substance can be assumed to be not inhibitory to aquatic microorganisms, if more than 25% degradation based on CO2 evolution occurred within 14 days in the toxicity control of a ready biodegradation test (OECD guideline 301). For the read-across substance Fatty acids, C16-18 and C18-unsatd., hexaesters with dipentaerythritol (CAS 68604-38-6) a biodegradation test according to OECD guideline 301B is available (Caduff, 2012). A toxicity control is included, which contains 20 mg/L of the test substance and 20 mg/L of the reference material (sodium benzoate). The toxicity control attained 26.7% degradation after 5 days of incubation (40.9% after 14 d) indicating that the test substance is not inhibitory to activated sludge microorganisms. Thus, a NOEC (14 d) of >= 20 mg/L was derived.

Based on this result from a structurally related read-across substance (in accordance to Regulation (EC) No 1907/2006 Annex XI, 1.5) which is characterized by a similar ecotoxicological profile and a similar structure, it can be concluded that Fatty acids, tall oil, esters with dipentaerythritol (CAS 70913-98-3) is not toxic to activated sludge microorganisms.
