Conclusion on classification

1) Classification according directive 2008/1272/EEC (CLP)

Classification according directive 2008/1272/EEC (CLP) is performed independently for acute and chronic hazards.

Acute hazard category:

The lowest acute aquatic toxicity value of three trophic levels was determined for Selenastrum capricornutum. The EC50(72h, growth rate) was determined as 88.0 mg/L. Thus, the submission substance is not classified for acute aquatic toxicity.

Chronic hazard category:

Decisive for the applied classification scheme is failure or fulfillment of (1) rapid degradability and (2) absence of a bioaccumulation potential.

As substitute for an experimentally determined BCF in fish log KOW is taken as an indicator of bioaccumulation potential. As log KOW of the submission substance is clearly below the cut-off value according to CLP of 4.0 (0.24 - 1.6), the submission substance is regarded as non-bioaccumulative.

Rapid biodegradability according to CLP is given for substances which were assessed as “readily biodegradable” in screening studies (OECD 301) with a minimum of 60% CO2-generation of theoretical maximum within 28 days and at the same time fulfillment of the 10-day-window. Data on biodegradability of the submission substance are inconclusive, as they are conflicting and either not reliable or not assignable (secondary source, original data not available). Thus the default assumption is that the substance is not rapidly degradable.

Thus, the resulting chronic aquatic hazard category based on the lowest acute toxicity value from three trophic levels (EC50 Selenastrum capricornutum: 88.0 mg/L) is

Category Chronic 3, resulting in the hazard statement H412: „Harmful to aquatic life with long lasting effects“. No M-factor for classification of mixtures is to be assigned.

2)             Classification according directive 67/548/EC (DSD)

In principle, the same aspects apply in respect of a potential for bioaccumulation and ready biodegradability as outlined above for classification according to CLP-regulation.

Thus, according to directive 67/548/EC the submission substance is classified as dangerous for the environment

R53, May cause long-term adverse effects in the aquatic environment.
