DVB-55/DVB-63


DVB-55 has a 96-hour LC50 in fish of 7.5 mg/L. The 48-hour EC50 in daphnia for DVB-55 and DVB-63 are 2.72, and 1.3 mg/L respectively. They are not readily biodegradable and there is no chronic data available. Therefore, no classification is warranted for acute aquatic endpoints, and an aquatic chronic Cat 2 (H411: Toxic to aquatic life with long lasting effects) is warranted according to EU Classification, Labelling and Packaging of Substances and Mixtures (CLP) Regulation (EC) No. 1272/2008.


DVB-HP


Acute aquatic data for DVB-HP include an LC50 in fish of 1.78 mg/L, a 48-hour EC50 in daphnia of 0.69 and 1.87 mg/L, a 72-hour EC50 (biomass) in algae of 1.73. Based on the acute Daphnia EC50 of 0.69 mg/L, the substance warrants an acute aquatic classification of Cat 1 (H400: Very toxic to aquatic life) according to EU Classification, Labelling and Packaging of Substances and Mixtures (CLP) Regulation (EC) No. 1272/2008. A NOEC of 0.81 mg/L in algae and a 21-day NOEC in daphnia of 0.353 mg/L, along with the fact that DVB-HP is not readily biodegradable warrants a classification of chronic aquatic Cat 2 (H411: Toxic to aquatic life with long lasting effects) according to EU Classification, Labelling and Packaging of Substances and Mixtures (CLP) Regulation (EC) No. 1272/2008.


Acute M-Factor Justification


 In accordance with article 10 of the CLP Regulation (EC) No. 1272/2008, if an M-factor is not yet given in Part 3 of Annex VI to the CLP Regulation, an M-factor should be determined and a scientific justification provided, when classifying substances for Acute Category 1 or Chronic Category 1. For this substance, adequate acute aquatic data are available in fish, aquatic invertebrate, and algae. An Acute M-Factor is based o the lowest reported effects in the most sensitive species aquatic invertebrate. Therefore, the M-factor is 1 based on the 48-hr EC/LC50 of 0.69 mg/L in aquatic invertebrate.
