Three studies are reported assessing the acute toxicity of bis(2 -ethylhexyl)maleate to the freshwater invertebrate Daphnia magna. Toxicity data for saltwater species is not available. Two reliable studies were conducted using the German DIN 38 412 standard. They reported EC50 values of 348 mg/l and a range between two dilution steps of > 37-< 74 mg/l, respectively, both without analytical determination of the test substance concentration. The third study was conducted according to OECD 202 including analytical determination of the test substance concentrations. An EC50 value of 59.5 mg/l is reported here. This study was selected as the key study as its toxicity value is the lowest one of the three studies conducted. To base the key parameter to the range achieved in one of the German DIN studies is not justified as it can not clearly be said whether the EC50 of this study is higher or lower than the one achieved in the OECD study although the lower value of the range given is lower than the EC50 value chosen as the key parameter.
