The following data on aquatic toxicity are available from tests with (2R)-2-(4-{[5-(trifluoromethyl)pyridin-2-yl]oxy}phenoxy)propanoic acid (i.e. the R-enantiomer) and 2-(4-{[5-(trifluoromethyl)pyridin-2-yl]oxy}phenoxy)propanoic acid (i.e. the racemate):

Short-term toxicity to fish: LC50 = 117 mg/L, 96 h, Oncorhynchus mykiss, semi-static, OECD 203, Hill (racemate).

Long-term toxicity to fish: NOEC ≥ 1.37 mg/L, 32 days, Pimephales promelas, flow through, OECD 210, Oran (read-across from data of the sodium salt of the R-enantiomer)

Short-term toxicity to aquatic invertebrates: EC50 = 240 mg/L, 48 h, daphnia magna, static, OECD 202, Getty (racemate).

Toxicity to aquatic algae and cyanobacteria: EC50 > 46.8 mg/L, 96 h, Pseudokirchnerella subcapitata, static, OECD 201, Williams (racemate).

Conclusion on classification

None of the available acute aquatic toxicity data on the racemate indicates a hazard LC50 < 100 mg/L. From the three trophic levels for which median acute concentrations could be determined, fish have the lowest (limited effects on algae were observed up to the highest concentration tested). Because no information on biodegradability is available, the substance should not be classified R52/53. Similarly, R53 should not be applied due to the lack of information on biodegradability, and an estimated water solubility of >8300 mg/L. As a result, there is insufficient evidence to classify the substance for environmental hazards, according to the criteria laid out in Directive 67/548/EEC, as amended for the 28th time in Directive 2001/59/EC, Annex VI, 5.2. This classification is considered to be inconclusive.

None of the available acute aquatic toxicity data on the racemate indicates a hazard LC50 < 100 mg/L. From the three trophic levels for which median acute concentrations could be determined, fish have the lowest (limited effects on algae were observed up to the highest concentration tested). Chronic Category 3 should not be applied due to the lack of information on biodegradability, the partition coefficient is logPow<4, and a long-term fish NOEC is available (see above). As a result, there is insufficient evidence to classify the substance for environmental hazards, according to the criteria laid out in Regulation (EC) No. 1272/2008, Annex I, Part 4, 4.1.2.This classification is considered to be inconclusive.
